These Terms of Use ("Terms") govern your use of itsdearher.com, operated by itsdearher ("we", "us", "our"). By accessing or using the site, creating an account, or placing an order, you agree to these Terms. Please read them carefully.

1. What we offer

itsdearher sells personalised digital gifts — surprise websites, sealed "open when" letter kits, and quizzes — built from the content you provide (names, photos, and messages). We may also offer physical self-care products from time to time; where offered, those are clearly marked as physical items with shipping information at checkout.

2. Eligibility & accounts

You must be at least 18 years old, or using the site under the supervision of a parent or guardian, to make a purchase. You are responsible for keeping your account credentials secure and for all activity under your account.

3. Orders & pricing

• All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise
• We reserve the right to correct pricing errors and to refuse or cancel orders placed at an incorrect price, with a full refund if payment was already made
• Digital gift pages are generated and delivered based on exactly what you enter into the builder — please review your recipient's name, photos, and message carefully before paying, as these determine the final page
• Order confirmation is sent to the email address you provide at checkout

4. Payments

Payments are processed securely through PayU (cards, UPI, net banking) or, where offered on physical orders, Cash on Delivery. We do not store your card or bank details. By paying, you confirm you are authorised to use the chosen payment method.

5. Delivery

Digital products (surprise pages, letter kits, quiz results) are generated and delivered instantly to the link/email associated with your order upon successful payment. For delivery timelines on physical products, see our Shipping Policy.

6. Cancellations & refunds

Full details are in our Cancellation & Refund Policy. In short: because digital gifts are generated and delivered instantly, refund eligibility is limited and time-bound as described there.

7. Acceptable use

When using itsdearher, you agree not to:

• Upload content you do not own or have permission to use, or that is illegal, hateful, harassing, sexually explicit, or infringes someone else's rights or privacy
• Use the site to send content intended to threaten, bully, or harm another person
• Attempt to interfere with, hack, or disrupt the site's normal operation
• Use automated tools to scrape or abuse the platform
• Misrepresent your identity to defraud another user or us

We reserve the right to remove content or suspend accounts that violate these Terms, without refund, where the violation directly caused the removal or suspension.

8. Content ownership

You retain ownership of the photos, names, and messages you upload. By submitting content, you grant us a limited licence to host, store, and display it solely to generate and deliver your gift page or order. The itsdearher brand, designs, templates, and site code remain our property.

9. Third-party links & services

The site may link to or embed third-party services (WhatsApp, Instagram, payment gateways). We are not responsible for the content, policies, or practices of those third parties.

10. Limitation of liability

itsdearher is provided "as is." To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the site or products purchased on it. Our total liability for any claim will not exceed the amount you paid for the relevant order.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the site after changes are posted means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts of India.
